A Look at The Violence Against Women Act

Senator Joseph Biden just announced his bid for the presidency; a candidacy which will certainly be embraced by the influential domestic violence lobby. As sponsor of the Violence against Women Act (VAWA), Senator Biden has won the cause of eliminating domestic violence and aligned himself with a very powerful feminist special interest. For a Democrat in the Senate, championing this cause is a political no-brainer. The question is will he risk the benefits of this political gravy train to admit this “Emperor” is not wearing clothes.

The domestic violence community is now a billion dollar industry, creating political fiefdoms of unprecedented power in our local communities. We have come to know domestic violence is at such epidemic proportions, that in our collective shame we have sanctioned a movement that has become cult-like in its power over our courts.

Each day, a few people turns into a target of this fake domestic violence, usually a very capable mother or father being given a restraining order in a few family court anywhere in this country. The complainants don’t even need to provide one piece of proof to support their complain yet the respondent needs to go through an extremely shameful process that even murderers and other criminals are not put through since they’re covered by the 6th Amendment.

Responding to a TRO is an arduous, humiliating, and expensive task. As a direct consequence, respondents are often separated from their children, suffer from depression, and exhibit indications of Post Traumatic Stress Disorder. Most of the falsely accused endure the emotional scars of never being vindicated.

Men are more likely to be wrongly accused and victimized by restraining orders although there are a growing number of female victims wrongfully served with restraining orders by abusive males. In a court case in San Francisco just lately, a woman was served a TRO despite her husband threw her down the stairs. Her clever husband claimed she was emotionally unpredictable and was afraid for his life and filing a restraining order was merely for his protection.

The topic of domestic violence is filled with complexities. It can’t be fixed by just one generic approach to all situations since family issues are unique and do not fit standard models. In case the statements are verifiable and supported with hard evidence, it’s only then the Violence against Women Act penalties and punishments should be used. Studies have shown that almost fifty percent of related cases don’t even meet the VAWA criteria and these cases must be subject to further evaluation and study before extreme measure are taken which will irreversibly ruin the members of the family. Additionally, there should be serious punishment to those who falsely accuse others or even their lawyers who aid them promote their wicked deeds to ensure that they could benefit from them.

Capital Hill should sanction the Violence Against Women Act, but with conditions that balance the system — a system that in some jurisdictions borders on fanatical. Senator Biden, we just can’t remain ignorant to the damage this legislation can cause innocent, gullible adults and kids swept up its tide wave.
