The smuggling of prohibited items into and within prisons is the origin of many issues found in the prison system and an activity which prison authorities are constantly attempting to stamp out. Even goods which might not sound very threatening can kill. A mobile phone might not seem like a weapon, but it’s understood that they have been smuggled into prisons and used by gang members to arrange criminal activity outside of prison.
The vast majority of smuggled things however are clearly not designed for much good at all. Over the past year prison staff has made 64 seizures which includes items such as a scalpel, scissors, tweezers, cameras, mobile phones and drugs.
Unfortunately what is most dissapointing concerning this information is that over the past two years eight lawyers or solictors visiting HMP Manchester had forbidden items seized. The records may be confined to one location of the UK but a west London solicitor could be doingjust the same.
A London solicitor is no different to any other solicitor. This could be a much wider problem than first predicted and although it is terrible to hear about legal professionals and solicitors helping to smuggle items into prison, this in fact highlights that almost any member of the public can visit an individual in prison and have a decent likelihood of smuggling in banned or illegal items.
Under current law (Offender Management Act 2007) anyone found with illegal goods will have them confiscated and will receive a caution. Thankfully the new Crime and Security act will become law in 2011 and serve as a solid deterrant to likely smugglers.
If found guilty, the consequences for lawyers and solicitors would be considerable. At minimum the Solicitors Regulation Authority would investigate the case and take suitable action which could end a career and at worst could result in prosecution and a prison sentance.
There is no doubting the dissatisfaction of hearing that people who have spent years in education and training in the legal system and then go on to break the law in such brainless behaviour. If you hire a well reputed west London solicitor it is reasonable to expect that they have certain moral and ethical values.
It must be taken into consideration that the quantity of solicitors and lawyers identified smuggling items into prisons is very low and nowhere near pandemic levels. Nevertheless the judiciary must look into the problem and make the necessary changes to the law and legal system.
It is entirely unacceptable for convicted criminals to carry out criminal activity from behind bars thanks to mobile phones being smuggled in by whomever it may be. Lawyers, solicitors and politicians must give their complete support to this piece of legislation.
